Welcome to AdForge AI ("we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

By using our platform, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

AdForge AI provides an AI-powered advertising platform that enables users to:

• Generate advertising creatives using artificial intelligence
• Connect and manage advertising platform accounts
• Build and optimize advertising campaigns
• Access analytics and insights for advertising performance
• Receive AI-powered recommendations for campaign improvement

We reserve the right to modify, suspend, or discontinue any part of our services at any time.

Our platform utilizes the following third-party AI models for content generation:

• Flux - For image generation
• Kling AI - For video generation
• GPT Image - For image generation

Our service's performance and availability may be affected by these third-party AI model providers. We do not guarantee specific output quality from AI-generated content. AI outputs may contain inaccuracies and should be reviewed before use.

To use our services, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

All paid plans are one-time credit pack purchases — you pay once and receive a set number of credits that expire after 30 days. There is no recurring billing or automatic renewal.

Credits expire within 30 days of purchase. Unused credits are not refundable after the expiration period. You may purchase additional credit packs at any time.

All fees are non-refundable except as required by law or as explicitly stated in our Refund Policy.

All payments are processed securely through Waffo Pancake, our payment processing partner and Merchant of Record. We do not store your full payment card details on our servers.

You agree NOT to use our services to:

• Create or promote false, misleading, or deceptive advertising
• Violate any intellectual property rights or trademarks
• Advertise illegal products, services, or content
• Engage in fraudulent or deceptive marketing practices
• Violate any applicable advertising platform policies (Meta, TikTok, Tencent)
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to our systems
• Use automated tools to extract data without permission
• Interfere with or disrupt our services or servers
• Generate deepfake content impersonating real individuals
• Create content depicting child exploitation or sexualization

6.1 AI-Specific Prohibitions

In addition to the above, you agree not to:

• Use inputs, outputs, or model responses to train, fine-tune, or develop competing AI or machine learning models
• Massively scrape or collect model outputs for purposes beyond your authorized use
• Represent AI-generated content as human-created professional advice (medical, legal, financial)

You retain ownership of content you provide to our platform. By uploading or providing content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing our services to you.

You represent that you own or have the necessary rights to all content you provide, and that such content does not infringe on the rights of any third party.

We will not use your input content for training AI models without your explicit consent.

Our services and related software, technology, and content are protected by intellectual property laws. You may not:

• Copy, modify, or distribute our platform without permission
• Reverse engineer or extract source code from our services
• Remove any proprietary notices or labels
• Use our trademarks or branding without written consent

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AdForge AI SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Any damages resulting from actions taken based on AI-generated recommendations
• Performance or results of advertising campaigns
• Any errors, delays, or interruptions in service

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

• That AI-generated content will achieve specific results
• Uninterrupted or error-free service
• That the service will meet your specific requirements
• That campaign performance will meet your expectations

⚠️ AI outputs may contain inaccuracies, incomplete information, or outdated content. Do not use AI-generated content for legal, medical, financial, or other professional advice without independent verification.

You agree to indemnify and hold harmless AdForge AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Your advertising content or campaigns

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You fail to pay fees when due
• We believe your use poses a risk to others

Upon termination, your right to use the services stops immediately. We may retain certain information as required by law.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or in appropriate courts of competent jurisdiction.

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through our platform. Your continued use after changes constitutes acceptance of the updated Terms.
